Terms of Service

These Terms of Service ("Terms") govern your access to and use of the email hosting and shared web hosting services provided by MailPlan.cc ("MailPlan", "we", "us", or "our").
By creating an account, purchasing a service, hosting a website, or otherwise using MailPlan.cc, you agree to these Terms. If you do not agree, you may not use our services.
1. The Service
MailPlan.cc provides two categories of internet services:
- Email hosting: the ability to create, send, receive, store, and manage email through domains and email accounts supported by our platform.
- Shared web hosting: hosting of websites and web applications on shared servers operated by us, including file storage, databases, one-click application installs, SSL certificates and related tooling.
The exact features, storage limits, technical specifications, and other limitations depend on the plan or service purchased and are described on the relevant product pages.
We may modify, improve, replace, or discontinue features where reasonably necessary for technical, security, legal, or operational reasons.
2. Shared Hosting Service Terms
The following additional terms apply to the shared web hosting service:
- Bring your own domain. We do not register domains. You must own the domain you point at our servers and are responsible for its DNS configuration.
- Resource limits and fair use. Each plan includes a specific amount of disk storage. Other resources — including bandwidth, number of websites/domains, subdomains, aliases, databases and FTP accounts — are not subject to hard caps but are provided under a fair-use policy that protects service quality for all customers on a shared server.
- Quota enforcement. We warn you when storage usage approaches the plan limit. When the limit is reached, the account may be automatically suspended until space is freed or the plan is upgraded.
- Website email. Shared hosting includes a sending relay for website-generated email (for example contact forms and application notifications) limited to 100 emails per day, with sensible burst limits to prevent abuse. A higher limit is available by attaching any MailPlan email plan to your account, in which case the relay follows that plan's allowances.
- Account isolation. Each hosting account runs in an isolated environment with its own system user. You must not attempt to access files, databases, processes or environments belonging to other customers or to the platform itself, or attempt to circumvent isolation or other security measures.
- Security scanning. Hosted files may be scanned automatically for malware, web shells and other threats. Files identified as malicious may be quarantined automatically; see section 6.
- Server maintenance and migration. To maintain or improve the service we may move hosting accounts between servers, where necessary with brief downtime. Where reasonably possible we will announce scheduled maintenance in advance.
Shared servers host multiple customers. Activities that degrade performance, stability or security for other customers may be limited or suspended.
3. Eligibility and Account Responsibility
You are responsible for:
- Providing accurate account and contact information.
- Keeping your login credentials secure.
- All activity performed through your account.
- The actions of anyone to whom you provide access to your account, email services or hosting account.
- Ensuring that your use of MailPlan complies with applicable laws and regulations.
You must notify us promptly if you believe your account has been accessed without authorization.
You may not create an account or use our services for unlawful, fraudulent, abusive, or malicious purposes.
4. Acceptable Use
You may use MailPlan.cc only for legitimate communication, lawful website content and lawful purposes.
You must not use, or allow others to use, our services to:
- Send spam or unsolicited bulk email.
- Send phishing emails.
- Send scam, fraud, or deceptive messages.
- Impersonate another person, company, organization, or service without authorization.
- Attempt to steal passwords, financial information, personal information, or other sensitive data.
- Distribute malware, ransomware, viruses, or other malicious software — including hosting web pages that distribute, promote or facilitate such software.
- Host phishing pages, fake login pages, scam pages or other deceptive website content.
- Operate proxies, VPN gateways, Tor exit nodes, IRC servers, game servers, streaming relays or similar infrastructure-heavy services on shared hosting.
- Mine cryptocurrency or run resource-intensive background processes that materially degrade shared server performance.
- Operate file-sharing, warez, torrent trackers or repositories of pirated content.
- Conduct port scans, penetration testing, denial-of-service attacks or any attack against other systems, networks or websites.
- Send emails containing fraudulent offers, investment scams, fake invoices, or other deceptive content.
- Conduct identity theft or social engineering attacks.
- Harass, threaten, stalk, or abuse others.
- Distribute illegal content.
- Violate intellectual property rights.
- Attempt to bypass security measures, account isolation, or abuse our infrastructure.
- Use compromised accounts or unauthorized access credentials.
- Resell or redistribute the service without our permission.
- Use the service in a manner that may damage our reputation, infrastructure, IP address reputation, or relationships with network providers.
- Interfere with the operation or security of MailPlan.cc or other users' services.
5. Spam, Scam, Phishing, and Abuse Policy
MailPlan.cc has a strict policy against spam, scams, phishing, fraud, and other abusive activity — whether conducted through email or through hosted websites.
An account may be immediately suspended or restricted without prior warning if we reasonably believe it has been used for:
- Spam or unsolicited bulk email.
- Phishing.
- Scams or fraud.
- Malware distribution.
- Hosting deceptive, fraudulent or harmful website content.
- Credential theft.
- Account compromise or suspicious automated activity.
- Attempts to evade abuse detection or security systems.
- Any other activity that presents a security, legal, reputational, or operational risk.
We may take action based on automated detection systems (including automated scanning of hosted files), abuse reports, complaints from recipients or providers, blocklist listings, unusual patterns, security investigations, or other information reasonably indicating abuse.
Immediate suspension may occur before we contact you or complete an investigation where necessary to protect MailPlan.cc, our users, recipients, or third parties.
6. Malware Quarantine and Illegal Content
Hosted files are automatically scanned for viruses, web shells and other malicious code. Where malicious files are found:
- We may move the affected files into quarantine so they cannot execute or be served, while preserving copies for review.
- We will notify the account holder and our own team of the finding.
- Restoration of quarantined files is at our discretion after review.
Where we reasonably suspect that hosted content is illegal — including content depicting the sexual abuse or exploitation of minors:
- The hosting account will be suspended immediately.
- The material and related evidence will be preserved and will not be deleted pending review.
- We may be legally obliged to report the matter to law enforcement or a recognized reporting hotline, and we will comply with such obligations.
- Notification to the account holder may be withheld or delayed where providing it could prejudice an investigation or is otherwise inappropriate.
We do not tolerate the use of our services for any illegal purpose and will cooperate fully with competent authorities within the framework of applicable law.
7. Suspension and Termination
We may suspend, restrict, or terminate your account if:
- You violate these Terms.
- Your account is involved in spam, scams, phishing, fraud, or other abuse.
- Hosted website content violates these Terms or applicable law.
- Your account has been compromised.
- Automated security systems flag your account as described in sections 5 and 6.
- We are required to do so by law or a valid legal process.
- Your use creates a security, operational, or reputational risk.
- You fail to pay applicable fees.
- You provide false or misleading account information.
For serious violations, including spam, phishing, scams, fraud, malware distribution or the hosting of illegal content, termination may be permanent and may occur without prior warning.
Where reasonably possible, we may allow you to appeal a suspension. However, we are not required to restore an account that we reasonably believe presents a risk or has violated these Terms.
We may preserve relevant information where necessary for security investigations, abuse prevention, legal compliance, or the protection of our rights.
8. Email Deliverability
Email delivery depends on many factors outside our control, including:
- Recipient mail server policies.
- Spam filtering systems.
- DNS configuration.
- Domain reputation.
- IP address reputation.
- Email content.
- Authentication records such as SPF, DKIM, and DMARC.
- Sending patterns and recipient complaints.
MailPlan.cc does not guarantee that every email sent through our service — whether from a mailbox or from a hosted website — will be delivered, accepted, or placed in a recipient's inbox.
We may impose technical restrictions or sending limits (including the shared-hosting website email limits described in section 2) where necessary to protect service reliability or prevent abuse.
9. Migrations and Transfers
We provide tools to help you migrate existing hosting into MailPlan, such as importing backup archives from previous providers, fetching archives from a URL, or pulling files directly from a server you control.
By using these tools you confirm that:
- You own or are authorized to migrate all content imported.
- Any credentials you supply for a third-party server are used strictly read-only by us for the purpose of the migration.
- Credentials supplied for a migration are used once and deleted after the migration completes or fails.
Imports from third-party providers are performed on a best-effort basis. Archive formats differ between providers and some data (such as mail, database stored procedures or provider-specific configuration) may not transfer completely or at all.
You are responsible for keeping your own complete backup before starting a migration, and for verifying the result afterwards. MailPlan.cc is not liable for incomplete, failed or corrupted migrations originating from third-party systems, except where liability cannot legally be excluded.
10. User Content, Website Files and Email Data
You retain ownership of the content you store, host and send through your MailPlan.cc account, including website files, databases and email.
You are solely responsible for your content and for ensuring that you have the necessary rights and permissions to store, host, send, receive, or otherwise process that content — including the content of any website you host on our servers.
We do not claim ownership of your content merely because you use our services.
We may access, preserve, review, or disclose information only where reasonably necessary to:
- Provide or maintain the service.
- Investigate abuse or security incidents, including automated security scanning of hosted files as described in sections 2 and 6.
- Prevent fraud or spam.
- Comply with applicable law or valid legal requests.
- Protect MailPlan.cc, our users, or third parties.
The handling of personal data is further described in our Privacy Policy.
11. Privacy and Data Protection
MailPlan.cc operates from and is legally based in the Netherlands.
Where applicable, we process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
You are responsible for ensuring that your own use of MailPlan.cc complies with applicable privacy and data protection laws.
If you use our services to process personal data belonging to others, you may have independent legal obligations as a controller or processor of that data.
12. Security
We take reasonable technical and organizational measures to protect our services and infrastructure — including account isolation on shared hosting servers, automatic malware scanning, encrypted backups and mandatory two-factor authentication for platform staff.
However, no internet-based service can guarantee absolute security.
You are responsible for:
- Using strong, unique passwords for your account, mailboxes, databases and applications.
- Keeping your account credentials confidential.
- Keeping hosted applications (such as WordPress and its plugins/themes) up to date and securely configured.
- Maintaining the security of devices used to access your account.
- Promptly reporting suspected unauthorized access.
MailPlan.cc is not responsible for losses resulting from unauthorized access caused by compromised credentials, outdated or insecure hosted applications, insecure devices, or failures to follow reasonable security practices, except where liability cannot legally be excluded.
13. Backups and Data Loss
You are responsible for maintaining your own backups of important emails, website files, databases and other data unless a specific backup service or retention period is explicitly included in your plan.
For shared web hosting, daily encrypted backups are included with paid plans (not with the Free plan) and are typically retained for up to seven days unless stated otherwise on the product page. Backup availability and retention may vary per plan.
While we perform backups and redundancy measures for operational purposes, these measures do not constitute a guarantee that all data can always be recovered.
You should not rely on MailPlan.cc as your sole backup solution.
14. Payments, Renewals and Refunds
Fees for paid services must be paid according to the selected plan and billing period.
Unless otherwise stated, services may be suspended or terminated if payment is overdue.
We may change prices for future billing periods. Where required, we will provide reasonable notice before a price change takes effect.
We provide a free plan with real resources so that you can thoroughly test the platform prior to purchasing a paid plan. Consequently, payments made for paid plans are non-refundable once processed.
You may cancel your subscription at any time via your client area to prevent future renewals.
If your service is terminated because of a violation of these Terms, including spam, scams, phishing, fraud, malware distribution or the hosting of illegal content, you are not entitled to a refund.
15. Third-Party Services
Our services may rely on third-party providers, including infrastructure, domain, network, security, payment providers and open-source software components.
Applications installed through one-click installers (such as WordPress) are third-party products licensed under their own terms; you are responsible for their configuration, updates and compliance.
We are not responsible for failures, interruptions, or changes caused by third-party services outside our reasonable control.
16. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation.
Services may occasionally be unavailable due to:
- Maintenance.
- Hardware or software failures.
- Security incidents.
- Network problems.
- Third-party outages.
- Server maintenance or account migrations between servers, which may involve brief downtime.
- Force majeure events.
- Other circumstances outside our reasonable control.
We may perform emergency maintenance or take immediate action to protect the security or stability of the service.
17. Limitation of Liability
To the maximum extent permitted by applicable law, MailPlan.cc shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, loss of business, loss of reputation, loss resulting from email delivery failures, or loss resulting from failed or incomplete migrations.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable law.
Where liability is legally permitted to be limited, MailPlan.cc's total liability relating to the service shall be limited to the amount you paid to us for the affected service during the period immediately preceding the event giving rise to the claim.
18. Indemnification
You agree to indemnify and hold MailPlan.cc harmless from claims, damages, losses, liabilities, and reasonable costs arising from:
- Your violation of these Terms.
- Your unlawful use of the service.
- Content hosted on, distributed through, or published via your account — including website content.
- Spam, scams, phishing, fraud, or other abusive activity conducted through your account.
- Your violation of another person's rights.
This clause applies only to the extent permitted by applicable law.
19. Changes to These Terms
We may update these Terms from time to time.
The latest version will be published on MailPlan.cc and will include an updated effective or revision date.
If a change materially affects your rights, we may provide additional notice where reasonably appropriate or legally required.
Continued use of the service after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires a different process.
20. Termination by You
You may stop using MailPlan.cc and cancel your service at any time, subject to any applicable billing commitments.
You are responsible for exporting or backing up your data — including emails, website files and databases — before cancelling your account.
After termination, your email accounts, hosting accounts and stored data may be deleted in accordance with our retention procedures and applicable law.
21. Governing Law
These Terms are governed by the laws of the Netherlands.
Where legally permitted, disputes relating to these Terms or the use of MailPlan.cc shall be submitted to the competent court in the Netherlands.
If you are a consumer and mandatory consumer protection laws provide additional rights or jurisdictional protections, those mandatory rights remain unaffected.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
23. No Waiver
If MailPlan.cc does not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce that provision later.

For abuse reports involving spam, phishing, scams, fraud, malicious website content or other illegal or harmful activity, please include as much relevant information as possible, such as email headers, URLs, timestamps, affected addresses and supporting evidence.
By creating an account, purchasing a plan, hosting a website or using MailPlan.cc, you confirm that you have read, understood, and agree to these Terms of Service.
